Spring Valley man sentenced to a total of eight years in prison in three seperate cases in Mower County District Court
A Spring Valley man facing criminal sexual conduct, burglary, domestic assault and damage to property charges in Mower County District Court stemming from an incident that took place in Austin on November 3rd, 2021, a felony fleeing a peace officer in a motor vehicle charge for an incident that occurred in January of 2022, and who was also facing domestic abuse, stalking and burglary charges from an incident that took place in Austin on March 8th, 2022 has been sentenced to a total of eight years in prison.
43-year old Tyler Scott Rubin was sentenced Thursday to 75 months in prison for a felony charge of 1st degree burglary of a dwelling, occupied, non-accomplice present, and to 17 months in prison for a felony charge of 1st degree damage to property, value reduced by over $1,000 stemming from the incident that took place in Austin on November 3rd, 2021. Rubin was given credit for 345 days already served, and he was convicted on the two charges after pleading guilty to them on December 27th, 2022. Felony charges for 5th degree criminal sexual conduct, nonconsensual, an additional charge of 1st degree burglary of a dwelling, occupied, non-accomplice present, plus a misdemeanor charge for domestic assault in the case against Rubin were dismissed with his guilty pleas. Judge Natalie Martinez determined that Rubin will be allowed to serve the two sentences concurrently.
Rubin was also sentenced Thursday to 19 months in prison for a felony charge of fleeing a peace officer in a motor vehicle stemming from an incident that took place in Mower County on January 14th, 2022. Rubin was convicted on the charge on December 27th, 2022 after pleading guilty the same day, and a gross misdemeanor charge for obstructing the legal process, interfere with a peace officer in the case against Rubin was dismissed with his guilty plea. Judge Martinez determined that Rubin will be allowed to serve the sentence concurrently with the two other prison sentences for the burglary and damage to property charges.
Rubin was also sentenced Thursday to 18 months in prison for a felony charge of stalking stemming from the incident that took place in Austin on March 8th, 2022. Rubin was convicted on the charge after pleading guilty on December 27th, 2022, and Judge Martinez determined that Rubin must serve the sentence consecutively with his other prison terms. A felony 1st degree burglary charge, and eight misdemeanor charges for violating a domestic abuse no-contact order in the case against Rubin were all dismissed with his guilty plea.
