Austin man sentenced to supervised probation on felony drug sale and possession charges in Mower County District Court
An Austin man who sold fake oxycodone pills that contained fentanyl to a confidential informant with the Mower County Sheriff’s Office on eight different occasions from October 14th to November 29th, 2022 has been sentenced to supervised probation and time in the sentence to service program in Mower County District Court.
30-year-old Donald Alvin Bakken II was convicted and sentenced Friday to five years of supervised probation and 40 hours in the sentence to service program for a felony charge of 2nd degree drugs, sale of 10 grams or more of a narcotic other than heroin within a 90-day period. A 48-month prison sentence was stayed for five years if Bakken complies with the 15 different conditions of his probation, and Bakken first pleaded guilty to the charge on November 17th, 2023. Seven felony counts of 3rd degree drugs, sale of a narcotic in the case against Bakken were all dismissed with his guilty plea.
Bakken was also convicted and sentenced Friday to four years of supervised probation and 40 hours in the sentence to service program for a felony 5th degree drug possession charge stemming from an incident that took place in Austin on January 4th, 2023. A prison term of one year and one day was stayed for four years if Bakken complies with the terms of his probation, and he was also convicted and sentenced Friday to 364 days in jail and two years of supervised probation for a gross misdemeanor charge of possession of any ammunition or firearm while being a user of a controlled substance stemming from the same incident. Judge Jeffery Kritzer stayed 309 days of the jail time for two years, and Bakken was given credit for 53 days already served. A felony charge for storing methamphetamine paraphernalia in the presence of a child or vulnerable adult, and a gross misdemeanor charge for possession of any ammunition or firearm while using a controlled substance in the case against Bakken were both dismissed with his guilty pleas.
Bakken pleaded guilty to both charges on November 17th, 2023, and Judge Kritzer determined that Bakken will be allowed to serve all three sentences concurrently.
