Austin man sentenced to jail time and supervised probation on fleeing a peace officer, DWI charges in Mower County District Court

An Austin man facing felony fleeing a peace officer in a motor vehicle and gross misdemeanor DWI charges in Mower County District Court after an attempted traffic stop in Austin on August 9th, 2023 has been sentenced to jail time and supervised probation.

22-year old Angel Miguel Diego was convicted and sentenced Thursday to 364 days in jail and two years of supervised probation for a felony charge of fleeing a peace officer in a motor vehicle.  Judge Jeffery Kritzer stayed 363 days of the jail time for two years if Diego complies with the 18 different conditions of his probation, and he was given credit for one day already served.  Diego was also convicted and sentenced Thursday to 364 days in jail and two years of supervised probation for a gross misdemeanor charge of 3rd degree DWI, operating a motor vehicle under the influence of alcohol.  Judge Kritzer again stayed 363 days of the jail time for two years if Diego complies with the terms of his probation, and he was given credit for one day already served.  Judge Kritzer also determined that Diego must serve 28 days of electronic home monitoring for possible use of alcohol.

Diego pleaded guilty to both charges on November 27, 2023, and a misdemeanor charge for driving after revocation in the case against Diego was dismissed with his guilty pleas.
