Austin man sentenced to jail time, supervised probation on felony criminal sexual conduct charges in Mower County District Court

An Austin man who was taken into custody after Mower County authorities became aware of multiple alleged probation violations after he was convicted and sentenced in August of 2023 on one felony count of 3rd-degree criminal sexual conduct with a juvenile has been sentenced to jail time and supervised probation after pleading guilty to a second felony 3rd degree criminal sexual conduct charge stemming from another case.  

19-year old Leonardo Antonio Nieto-Vasquez was convicted and sentenced Monday to 180 days in jail and 15 years of supervised probation after pleading guilty October 20th of 2023 to a felony charge of 3rd degree criminal sexual conduct, penetration, victim 14-15 years of age, actor more than 24 months older after sexually abusing a 14-year old girl in Brownsdale from March 1st to April 15th of 2023.  A 48-month prison sentence was stayed for 15 years if Nieto-Vasquez complies with the 23 conditions of his probation, and he was also given credit for 53 days already served.  Judge Natalie Martinez also determined that if Nieto-Vasquez has to serve the prison sentence, he would be subject to 99 years of conditional release after confinement.  

Nieto-Vasquez was also convicted and sentenced Monday to 180 days in jail, 10 years of supervised probation, and $1,000 in fines and fees after originally pleading guilty on May 12th, 2023 to an additional felony charge of 3rd degree criminal sexual conduct, penetration, victim 14-15 years of age, actor more than 24 months older after conducting a sexual relationship with a 14-year-old girl in Austin from April 12th through April 24th of 2023.  A 36-month prison sentence was stayed for 10 years if Nieto-Vasquez complies with 25 different conditions of his probation, and he was given credit for 53 days already served.  Nieto-Vasquez was first sentenced on the charge on August 17th, 2023, but he was convicted and sentenced again Monday after being taken into custody in October of last year after violating the terms of his probation, specifically, the court’s instructions to avoid contact with juveniles, and to avoid alcohol consumption.

An additional felony charge of 3rd degree criminal sexual conduct, penetration, victim 14-15 years of age, actor more than 24 months older, plus felony charges for solicit child through electronic communication to engage in sexual conduct, and for engaging in electronic communication relating or describing sexual conduct with a child in the case against Nieto-Vasquez stemming from the April 2023 incident in Austin were dismissed with his guilty plea.  

Judge Martinez also determined that Nieto-Vasquez will be allowed to serve the two sentences concurrently.
