Austin man sentenced to supervised probation on felony drug sale charge in Mower County District Court

An Austin man who sold approximately one gram of heroin to a pair of confidential informants with the Austin Police Department at a residence on the 700 block of 5th Ave. NW in Austin on August 7th, 2020 has been sentenced to supervised probation in Mower County District Court.

In an amended court decision, 26-year old Montana Richard Hinchley was sentenced Wednesday to five years of supervised probation for a felony charge of 3rd degree drugs, sale of a narcotic. A 21-month prison sentence was stayed for five years, and Hinchley was also sentenced to five years of supervised probation for an escape from custody charge stemming from an incident on August 10th, 2021.  A 13-month prison sentence was stayed for five years if Hinchley complies with the terms of his probation, and Judge Jeffery Kritzer determined that Hinchley will be able to serve the two sentences concurrently.

Hinchley first pleaded guilty to the two charges on December 6th, 2021, and he was convicted on both charges on March 3rd of this year.
