Austin man sentenced to supervised probation, fines and fees for charges of threats of violence, domestic assault in Mower County District Court

An Austin man who threatened to stab another man when broke into a residence in the 1000 block of 8th St. NW in Austin on February 8th, 2021 has been sentenced to supervised probation, fines and fees in Mower County District Court.

28-year old Ryan Matthew Berg was convicted and sentenced Thursday to two years of supervised probation for a felony charge of threats of violence.  Berg received a stay of imposition in the case where the defendant pleads guilty to a felony-level offense.  If he or she successfully completed their probation, the conviction will be deemed a misdemeanor.  Berg was also convicted and sentenced Thursday to two years of supervised probation and $1,085 in fines and fees for a misdemeanor charge of violating a domestic abuse no-contact order.  A 90-day jail sentence was stayed for two years if Berg complies with the terms of his probation, and Judge Kevin Siefken determined that the two sentences can be served concurrently.  Berg first pleaded guilty to the two charges on February 18th, and felony charges for 1st degree burglary, assault a person in a building or on property, 1st degree burglary, possession of a dangerous weapon and 1st degree burglary of an occupied dwelling, plus a felony charge for 2nd degree assault with a dangerous weapon in the case were dismissed with Berg’s guilty pleas.

Berg was also convicted and sentenced Thursday to 43 days in jail for a misdemeanor charge of domestic assault, commits act to cause fear of immediate bodily harm or death stemming from an incident that took place on October 11th, 2020.  Berg was given credit for 43 days already served, and he pleaded guilty to the charge on February 18th, 2022.  Misdemeanor charges for domestic assault, intentionally inflicts or attempts to inflict bodily harm on another, possession of over 1.4 grams of marijuana in a motor vehicle and a petty misdemeanor charge for possession of drug paraphernalia in the case were dismissed with Berg’s guilty plea.
